ANIMAL TRANSPORTATION AGREEMENT This Animal Transportation Agreement (the "Agreement") is entered into between Sargent LivestockTransport, hereinafter referred to as the "Transporter," and ______________________ hereinafter referred to as the "Owner," collectively referred to as the "Parties," on this day [______________]. 1. Services Provided: The Transporter agrees to provide transportation services for the Owner's animal(s), as specified below: Animal(s) Description: - Species: ___________________ - Age:_______________________ - Identification (Microchip/Tag Number):__________________ - Vaccination Records: - Special Instructions:____________________ 2. Transportation Conditions: 2.1 The Transporter agrees to exercise reasonable care and diligence in transporting the animals listed in Section 1 to the specified destination. 2.2 The Owner acknowledges and understands that there are certain risks associated with animal transportation, including but not limited to unforeseen accidents, injuries, or death, even with the exercise of due care by the Transporter. 2.3 The Transporter agrees to take necessary precautions to ensure the safety and well-being of the animal(s) during transportation, including but not limited to securing the animal(s) in a suitable crate or container, maintaining proper ventilation, and adhering to any specific instructions provided by the Owner regarding the animal's comfort or medical needs. 3. Owner's Responsibilities: 3.1 The Owner represents that they are the legal owner of the animal(s) listed in Section 1 and have the authority to enter into this Agreement. 3.2 The Owner agrees to provide accurate and up-to-date information about the animal(s), including any health conditions or specific instructions that the Transporter needs to be aware of. 3.3 The Owner shall ensure that the animal(s) are in good health and have received all required vaccinations and treatments prior to transportation. 3.4 The Owner shall provide the necessary documents, such as vaccination records and identification tags, to the Transporter prior to transportation. 4. Limitation of Liability: 4.1 The Owner acknowledges and understands that the Transporter shall not be held liable for the death of the animal(s) during transportation, except if such death is caused by the Transporter's gross negligence or willful misconduct. 4.2 The Owner agrees to indemnify and hold the Transporter harmless from any claims, damages, losses, liabilities, or expenses (including legal fees) arising out of or in connection with the transportation of the animal(s), except to the extent caused by the Transporter's gross negligence or willful misconduct. 5. Insurance: The Owner understands and acknowledges that it is their responsibility to obtain appropriate insurance coverage to protect against any risks associated with the transportation of the animal(s). The Transporter is not liable for any loss or damage to the animal(s) during transportation. 6. Governing Law and Jurisdiction: This Agreement shall be governed by and interpreted in accordance with the laws of the United States of America. Any disputes arising out of or in connection with this Agreement shall be submitted to the exclusive jurisdiction of the courts of the United States of America. 7. Entire Agreement: This Agreement constitutes the entire understanding between the Parties with respect to the subject matter hereof and supersedes all prior discussions, negotiations, and agreements, whether oral or written. This Contract Release ("Release") is made and into as of _______________, between Sargent Livestock Transport ("Owner") and ____________________ ("Recipient"), concerning the delivery and receipt of livestock/animal. Whereas, the Owner has transported and delivered the livestock/animal described as [Description of Animal] to the Recipient as per the terms of the original agreement dated ____________________, and Whereas, the Recipient does hereby confirm that the livestock/animal has been received in good condition and satisfactory health, and that the transport provided by the Owner was acceptable. Now, therefore, in consideration of the foregoing premises and the mutual covenants contained herein, the parties agree as follows: 1. The Recipient acknowledges the receipt of the livestock/animal(s) in good condition and confirms satisfaction with the transportation services provided by the Sargent Livestock Transport. 2. The Recipient releases the Owner, its agents, employees, and representatives from any further liability, claims, damages, or responsibilities related to the delivery and condition of the livestock/animal(s) described herein. 3. This Release constitutes the entire agreement between the parties, and no modification or amendment hereof shall be valid unless made in writing and duly executed by both parties. 4. This Release shall be binding upon and shall inure to the benefit of the parties hereto and their respective successors, assigns, and legal representatives. 5. This Release shall be governed by and construed in accordance with the laws of the United States of America, without regard to its conflict of laws principles.
